Disclosure of tax avoidance schemes - New powers proposed to investigate failure to disclose

The statutory rules for the disclosure of tax avoidance schemes has enabled the Government to respond more rapidly to new schemes and a number of proposed changes to tax law, not directly related to income tax, are described in the PBR documents.

In addition, the Government will be consulting on a new power to investigate a scheme where there are reasonable grounds to believe that a promoter has failed to comply with its statutory disclosure obligations. A consultation document is under preparation.

HMRC is to start sending out late filing penalty notices, starting 27 November, to those employers who it is believed sent in their 2005/06 Employer Annual Return (P35 and/or CIS36) late. Fixed penalties are charged where they were received after 29 May 2006. Employers who wish to appeal against the penalty should write to the office address shown on their penalty notice, giving their reasons why they think the penalty is incorrect.

These penalties should not be confused with the penalties issued from 30 October 2006 for failure to a return online, and the penalties issued from 13 November 2006 for late filing of P11Ds.
